Zakhyst Pratsi : Un appel des travailleur·se·s d’Ukraine aux travailleur·se·s de Biélorussie

Appel du membre de l’IP, le syndicat indépendant de toute l’Ukraine « Zakhyst Pratsi », aux travailleur·se·s de la Biélorussie, luttant contre la double menace des réformes néolibérales et du régime autocratique.

Cher·ère·s frères et sœurs de Biélorussie. Nous sommes impressionné·e·s par la force et le courage dont vous avez fait preuve dans votre lutte contre votre gouvernement antipopulaire. Le régime conservateur et oligarchique craignait, avant tout, une protestation décisive et organisée de la classe ouvrière biélorusse et de ses syndicats indépendants.

Ce sont vos grèves et vos protestations qui ont contribué à mettre fin au régime de violence policière qui terrorise le peuple biélorusse. Et vos actions ont contribué à faire entendre l’appel à l’annulation des résultats des élections présidentielles truquées.

Nous soutenons fermement vos demandes démocratiques pour des changements décisifs dans la société biélorusse, en traduisant en justice celleux qui ont falsifié les élections et les officier·ère·s des unités spéciales de police qui ont déclenché de graves abus de pouvoir contre le peuple.

Dans le même temps, nous ne pouvons pas oublier l’expérience amère de l’Ukraine. Le soulèvement populaire et juste contre le régime de Ianoukovitch en 2014 a été coopté par des forces ouvertement anti-ouvrières et anti-syndicales. En Ukraine, ces forces assiègent maintenant les droits démocratiques des travailleur·se·s et des militant·e·s syndica·les·ux, en augmentant l’âge de la retraite et en faisant passer une vague de réformes néolibérales antipopulaires.

Malheureusement, en 2014, les travailleur·se·s et les syndicats d’Ukraine ne pourront pas jouer un rôle significatif et efficace dans la révolution démocratique. Iels étaient faibles et désorganisé·e·s. Aujourd’hui, nous assistons au même phénomène en Biélorussie, où les gardien·ne·s conservateur·rice·s du régime appellent les travailleur·se·s à s’opposer à la lutte pour la démocratisation en Biélorussie, à mettre fin à leurs grèves et, en fin de compte, à soutenir le régime autoritaire-capitaliste de Loukachenko.

Nous rejetons fermement ces appels à une collaboration de facto avec le régime. Seule une lutte soutenue pour la démocratie peut donner aux travailleur·se·s l’espoir que l’autoritarisme et la violence prendront fin. Mais la classe ouvrière et les syndicats de Biélorussie doivent de toute urgence développer leur propre programme de revendications – un programme qui empêchera l’avenir d’une Biélorussie libre et démocratique de succomber aux réformes néolibérales anti-travailleur·se·s. Ce sont précisément les réformes néolibérales et la privatisation totale qui ramèneront à la dictature et à la violence policière, et qui renforceront à nouveau les forces revanchistes de l’autoritarisme et celleux qui cherchent déjà à établir des régimes de contrôle externe – à la fois pro-occidentaux et pro-russes – sur la Biélorussie. La lutte pour la véritable indépendance d’une Biélorussie ouvrière démocratique est l’une des questions les plus urgentes de ce moment.

Nous, travailleur·se·s et militant·e·s syndica·les·ux ukrainien·ne·s, n’avons pas le droit d’imposer notre opinion à nos frères et sœurs biélorusses. Les travailleur·se·s de Biélorussie développeront indépendamment un programme de lutte syndicale et de travail. Cependant, nous croyons fondamentalement que nous avons le droit d’exprimer nos propositions, qui peuvent aider au développement du programme de travail et de lutte syndicale, ainsi qu’un ensemble de revendications pour les travailleur·se·s biélorusses. Parmi celles-ci, on peut citer:

  • L’annulation immédiate des réformes anti-travailleur·se·s et antisyndicales dans le Code du travail biélorusse de 2019, qui établit l’autorité totale des employeur·se·s dans le pays : contrats à durée déterminée, possibilité de licencier injustement des travailleur·se·s à l’initiative des directeur·rice·s, restriction de facto pour les travailleur·se·s démissionnant de leur emploi.
  • Sauver les emplois ! Interdire les amendes infligées aux travailleur·se·s par les dirigeant·e·s d’entreprises ! Et interdire de priver les travailleur·se·s de leurs primes !
  • L’annulation immédiate du programme de privatisation du gouvernement pour 2020, ainsi que l’inversion des privatisations achevées des principales entreprises biélorusses, en les nationalisant et en introduisant des pratiques de gestion démocratiques. Toutes les entreprises nationalisées en Biélorussie doivent être placées sous le contrôle des travailleur·se·s pour être gérées par les travailleur·se·s et leurs syndicats ! L’autonomie des travailleur·se·s au lieu d’une gestion bureaucratique de l’État !
  • Arrêter la réforme « Loukachiste » antipopulaire du système de retraite actuellement prévue par les autorités. Annuler immédiatement l’augmentation de l’âge de la retraite mise en œuvre par Loukachenko en 2020 !
  • L’abolition immédiate de toutes les restrictions législatives à la création de syndicats indépendants par les travailleur·se·s biélorusses. Les travailleur·se·s et la presse syndicale doivent avoir une liberté totale !

La lutte pour mettre en œuvre ces exigences transitoires ne peut réussir qu’à une condition : que les travailleur·se·s de Biélorussie établissent leurs propres liens stables et solides entre les collectifs de travail, les syndicats indépendants et les militant·e·s civil·e·s et environnementa·les·ux. Les forces libérales de droite sont maintenant beaucoup mieux organisées et essaieront de faire tout ce qu’elles peuvent – et beaucoup de choses qu’elles ne peuvent pas – pour que la classe ouvrière biélorusse ne devienne pas une force politique indépendante, mais suive docilement la voie des réformes capitalistes néolibérales antipopulaires tracée par un nouveau cadre de politicien·ne·s néolibéra·les·ux. Il serait donc juste que les syndicats indépendants de Biélorussie envisagent de désigner un·e candidat·e aux futures élections présidentielles. Ce·tte candidat·e pourrait attirer toutes les forces démocratiques et ouvrières de Biélorussie. La désignation d’un·e candidat·e syndical·e à la présidence biélorusse pourrait donc devenir une alternative stratégique viable, tant pour les forces de représailles autoritaires anti-travailleur·se·s que pour les nombreu·ses·x candidat·e·s de tendance impérialiste pro-russe ou pro-occidentale, qui sont déterminé·e·s à empêcher l’émergence d’une Biélorussie libre et démocratique.

Cher·ère·s frères et sœurs biélorusses de la lutte syndicale et ouvrière : les travailleur·e·s d’Ukraine sont à vos côtés ! Vous l’emporterez dans la lutte pour faire valoir vos droits ! Les yeux des gens du monde entier sont tournés vers vous, alors que vous êtes en première ligne dans la lutte pour une véritable démocratie et les droits des travailleur·se·s. Nous vous souhaitons courage, détermination et bonne chance !

أوكرانيا إلى عمال بيلاروسيا أوكرانيا إلى عمال بيلاروسيا

نداء من عضو التقدمية العالمية، النقابة العمالية المستقلة لعموم أوكرانيا “زاخيست

براتسي” إلى العمال في بيلاروسيا، لمحاربة التهديدات المزدوجة للإصلاح النيوليبرالي

والحكم الاستبدادي.الإخوة والأخوات الأعزاء في بيلاروسيا. إننا نشعر بالإجلال من القوة والشجاعة التي أظهرتوها في كفاحكم ضد حكومتكم المناهضة غير الشعبية. خشي النظام المحافظ والقائم على حكم الأقلية، فوق كل شيء، من احتجاج حاسم ومنظم من قبل الطبقة العاملة البيلاروسية ونقاباتها المستقلة.

لقد كانت إضراباتكم واحتجاجاتكم هي التي ساعدت على إنهاء نظام عنف الشرطة الذي كان يرهب الشعب البيلاروسي. وساعدت أفعالكم في رفع صوت الدعوة لإبطال نتائج الانتخابات الرئاسية المزورة.

نحن نؤيد بقوة مطالبكم الديمقراطية بإحداث تغييرات حاسمة في المجتمع البيلاروسي ، وتقديم أولئك الذين زوروا الانتخابات وضباط وحدات الشرطة الخاصة الذين أطلقوا العنان لانتهاكات جسيمة للسلطة ضد الشعب إلى العدالة.

في الوقت نفسه، لا يمكننا أن ننسى التجربة المريرة لأوكرانيا. إن الانتفاضة الشعبية العادلة ضد نظام يانوكوفيتش في عام 2014 احتوتها القوى المناهضة للعمال والنقابات. في أوكرانيا تفرض هذه القوى الآن حصارًا على الحقوق الديمقراطية للعمال والنشطاء النقابيين وتزيد من سن التقاعد، وتدفع بسلسلة من الإصلاحات النيوليبرالية المناهضة للشعبية.

لسوء الحظ في عام 2014 لم يتمكن العمال والنقابات العمالية في أوكرانيا من لعب دور مهم وفعال في الثورة الديمقراطية. كانوا ضعفاء وغير منظمين. اليوم نرى نفس المسرحية في بيلاروسيا، حيث دعا أوصياء النظام المحافظون العمال للوقوف ضد النضال من أجل التحول الديمقراطي في بيلاروسيا، وإنهاء إضراباتهم، ودعم نظام لوكاشينكا الاستبدادي الرأسمالي، بما لا يتعدى الكلمات.

نحن نرفض بشدة هذه الدعوات للتعاون الفعلي مع النظام. وحده النضال المستمر من أجل الديمقراطية يمكن أن يمنح العمال الأمل في إنهاء الاستبداد والعنف. لكن الطبقة العاملة والنقابات العمالية في بيلاروسيا بحاجة ماسة إلى تطوير برنامج مطالب خاص بهم – برنامج من شأنه أن يمنع مستقبل بيلاروسيا الحرة والديمقراطية من الخضوع للإصلاحات النيوليبرالية المناهضة للعمال. إن الإصلاحات النيوليبرالية والخصخصة الشاملة هي التي ستؤدي إلى الديكتاتورية وعنف الشرطة، وستقوي مرة أخرى كل من القوى الاستبدادية الانتقامية وأولئك الذين يسعون بالفعل إلى إقامة أنظمة سيطرة خارجية -على حد سواء المؤيدة للغرب والمؤيدة لروسية – فوق بيلاروسيا. النضال من أجل الاستقلال الحقيقي لبيلاروسيا العمالية الديمقراطية هو أكثر القضايا إلحاحًا في هذه اللحظة.

نحن، العمال الأوكرانيين والناشطين النقابيين، لا يحق لنا فرض رأينا على إخواننا وأخواتنا البيلاروسيين. سيطور عمال بيلاروسيا بشكل مستقل برنامجا للنضال العمالي والنقابي. ومع ذلك، نعتقد بشكل أساسي أن لدينا الحق في التعبير عن مقترحاتنا والتي يمكن أن تساعد في تطوير برنامج العمل والنقابات العمالية ومجموعة من المطالب للعمال البيلاروسيين. من بين هذه المقترحات:

  • الإلغاء الفوري للإصلاحات المناهضة للعمال والنقابات في قانون العمل لعام 2019 في بيلاروسيا والذي أنشأ السلطة الكاملة لأصحاب العمل في البلاد: من عقود محددة المدة، والقدرة على فصل العمال بشكل غير عادل بمبادرة من المديرين، وفرض قيود بحكم الأمر الواقع على استقالة العمال من وظائفهم.
  • حفظ الوظائف! حظر الغرامات المفروضة على العاملين من قبل مديري الشركات! ومنع حرمان العمال من مكافآتهم!
  • الإلغاء الفوري لبرنامج الخصخصة الحكومي لعام 2020، فضلاً عن عكس عمليات الخصخصة المكتملة للشركات البيلاروسية الرائدة — بتأميمها وإدخال ممارسات الإدارة الديمقراطية. يجب وضع جميع المؤسسات المؤممة في بيلاروسيا تحت مراقبة العمال ليديرها العمال ونقاباتهم العمالية! حكومة ذاتية للعمال بدلاً من إدارة الدولة البيروقراطية!
  • وقف الإصلاح المناهض للشعبية “الوكاشي” لنظام المعاشات التقاعدية الذي تخطط له السلطات حاليًا. إلغاء الزيادة في سن التقاعد التي نفذها لوكاشينكا في عام 2020 على الفور!
  • الإلغاء الفوري لجميع القيود التشريعية على إنشاء نقابات العمال المستقلة للعمال البيلاروسيين. يجب أن يتمتع العمال والصحافة النقابية بالحرية الكاملة!

لا يمكن للنضال من أجل تنفيذ هذه المطالب الانتقالية أن ينجح إلا بشرط واحد: إذا أقام عمال بيلاروسيا علاقاتهم المستقرة والقوية بين التجمعات العمالية والنقابات العمالية المستقلة والناشطين المدنيين والبيئيين. أصبحت القوى الليبرالية اليمينية الآن أكثر تنظيماً وستحاول القيام بكل ما في وسعها — وأشياء كثيرة لا يستطيعونها — حتى لا تصبح الطبقة العاملة في بيلاروسيا قوة سياسية مستقلة، لكنها تسير بطاعة على طول خط الإصلاح الرأسمالي النيوليبرالي المناهض للشعبية الذي وضعه كادر جديد من السياسيين النيوليبراليين. لذلك، سيكون من الصواب أن تنظر النقابات العمالية المستقلة في بيلاروسيا في تسمية مرشح في الانتخابات الرئاسية المقبلة. يمكن لهذا المرشح جذب جميع القوى الديمقراطية والعمالية في بيلاروسيا. يمكن أن يصبح ترشيح مرشح نقابي لرئاسة بيلاروسيا إذن بديلا استراتيجيا قابلا للتطبيق، سواء لقوى الانتقام الاستبدادي المناهض للعمال، أو للعديد من المرشحين الموالين لروسيا أو الموالين للإمبريالية الغربية، وهي مصممة على منع ظهور بيلاروسيا حرة وديمقراطية.

الإخوة والأخوات البيلاروسيين الأعزاء في النضال العمالي والنقابي: عمال أوكرانيا يقفون إلى جانبكم! ستنتصرون في النضال لتأكيد حقوقكم! عيون الناس في جميع أنحاء العالم عليكم، وأنتم تقفون على خط المواجهة في النضال من أجل الديمقراطية الحقيقية وحقوق العمال. نتمنى لكم الشجاعة والتصميم ونتمنى لكم التوفيق!

Open statement “For free democratic worker Belarus!”

Open statement “For free democratic worker Belarus!” to our Belarusian brothers and sisters of workers’ struggle from All-Ukrainian trade union ‘Labour Defence’.

Dear brothers and sisters in Belarus,

We are fascinated by your force and bravery in the struggle against the autocratic government. It is obvious, that conservative-oligarchic regime was afraid, first of all, the resolute and organized protest of the Belorussian working class and its independent trade unions. Just your strike and the working class protest in general allowed not only to stop open police brutality against Belarusian people, but also to resolutely raise an issue regarding the cancelation of the result of presidential elected, falsified by the regime.

We decisively support your present general democratic demands for resolute changes in Belarussian society, prosecution of those who fabricated the results of the election, and those of special police units, who extremely over-used their power.

It’s very important to remember the bitter experience of Ukraine, when just and fair uprising against Yanukovich regime in 2014 was used by openly anti-worker and anti-union forces. Just these forces are presently conducting the violent attacks against democratic rights of workers and trade union activists, increasing the retirement age and conducting the course of anti-people neoliberal reforms.

Unfortunately, working class and trade union activists in 2014 couldn’t become an efficient and significant factor of the democratic revolution in Ukraine. They were poorly organized and not enough prepared. This fact is being used by conservative ‘protectors’ of the autocratic regime, who try to convince workers to not support the struggle for democratic transformation in Belorussia, stop the strike and de-facto support autocratic-capitalistic Lukashenko regime.

We resolutely deny this calls for virtual collaboration with the regime. Only the consistent struggle for the democracy gives to workers a prospect to finally overcome autocracy and violence.  However, the working-class and labour unions of Belorussia should begin the development of their program of demands. This program would not allow future democratic and free Belorussia to fall onto the path of anti-worker neoliberal reforms and changes. Just neoliberal reforms and mass privatization will inevitably return the situation to renewal of dictatorship and police violence and will strength both reactionary revenge forces and those, who wish to establish in the Belorussia regime of external control, both pro-Western and pro-Russian. We believe that fight for true independence of working democratic Belarus is one of the most important issues of the current situation.

We, Ukrainian workers and trade union activists, don’t have a right to dictate our opinion for our Byelorussian brothers and sisters. Belorussian workers will elaborate workers and trade union program of struggle themselves.  However, we principally believe, that we have a right to give our proposals, which might become a base for the development of a current program for workers and trade unions and also for a list of demands of Belarusian workmen.  These proposals are the following:

  • Immediate cancelation of hostile to the workers and trade unions Belarussian Labour Code changes of 2019, which had established total dictate of employers in the country – temporary employment, unjustified terminations, the ban on voluntary resignation are the banes of Belarusian labourers.
  • Keep the workplace by all necessary means! Ban of fines by employers! Ban on bonus retention!
  • Immediate cancelation of government’s program of privatization of 2020. Review the conducted privatization of the number of leading Belarussian companies. Nationalization of such companies with following transition from government-backed bureaucratic administration to democratic governance by workers and employees!
  • Stop of proposed by Lukashenko’s government reform of retirement benefits! Immediate withdraw the increase of retirement age that has been established by law in 2020!
  • Prompt lift of all legal restrictions related to creation by Belorussian independent trade unions! Unrestricted freedom of the press for workers and trade union media!

There could be only one condition in the fight for fulfilment of your demand: workers of Belorussia need to and have to organize the stable and steady relationship with all of the Belarussian working collectives, with independent trade unions, with active members of communities and environmental activists.  Currently right-wing liberal forces are more organized, and they attempt to do everything to keep Belarusian workers out from becoming an autonomous political force, trying to keep them remaining at the outskirts of the neo-liberal politicians with their program of anti-people neo-liberal reforms. Therefore, it would be correct for independent Belarusian labour unions to discuss the issue of nomination of a candidate for the future presidential election. Such a candidate could become a gravity pull for all truly democratic and working forces in Belarus. Such action could be a real strategic alternative both the forces of anti-worker authoritarian revenge and numerous pro-Russian and pro-Western candidate, which are already turned to complete the dissolution of the independent democratic way to the future of free and people governed Belorussia.

Respected Belarusian brothers and sisters of labour and trade union struggle! Ukrainian working class stands with you! Please remember, that only in struggle we can win our rights! Presently your struggle is the most important point world-wide!  At this moment you are at the front line for true democracy and rights of the workers! Be vigilant, be resolute and thebest of luck!

«За свободную демократическую рабочую Беларусь!» (Обращение ВНПС “Захист праці”)

Открытое обращение Всеукраинского независимого профсоюза «Захист праці» к нашим белорусским братьям и сестрам по рабочей борьбе «За свободную демократическую рабочую Беларусь!»

Дорогие наши братья и сестры из Беларуси. Мы поражены вашей силой и мужеством в справедливой борьбе с антинародной властью. Очевидно, что консервативно-олигархический режим боялся, прежде всего, решительного и организованного протеста со стороны белорусского рабочего класса и его независимых профсоюзов. Именно ваши забастовки и акции рабочего протеста позволили остановить открытый полицейский террор против собственного народа, а также решительно поставить вопрос об отмене сфальсифицированных режимом результатов президентских выборов.

Мы решительно поддерживаем ваши нынешние общедемократические требования решительных изменений в белорусском обществе, наказания фальсификаторов свободного волеизъявления граждан и жестоко злоупотребивших властью сотрудников специальных полицейских подразделений.

Очень важно при этом нам не забыть горький опыт Украины, когда результатами народного и справедливого демократического восстания против режима Януковича в 2014 году воспользовались откровенно антирабочие и антипрофсоюзные силы. Именно эти силы сейчас ведут в Украине ожесточенные атаки против демократических прав рабочих и профсоюзных активистов, повышают пенсионный возраст, проводят курс антинародных неолиберальных реформ.

К сожалению, рабочий и профсоюзный актив Украины в 2014 году не смог стать действенным и существенным фактором демократической революции. Он был очень слаб и недостаточно организован. Этим пользуются сейчас консервативные охранители авторитарного режима, пытаясь уговорить рабочих не поддерживать борьбу за демократические изменения в Беларуси, прекратить забастовки и, фактически, поддержать авторитарно-капиталистический режим Лукашенко.

Мы решительно отвергаем эти призывы к фактической коллаборации с режимом. Только последовательная борьба за демократию дает рабочим надежду на окончательное преодоление авторитаризма и насилия. Но рабочему классу и профсоюзам Беларуси уже сейчас крайне необходимо приступить к выработке собственно рабочей программы требований, которая не даст пустить будущее свободной и демократической Беларуси по курсу антирабочих неолиберальных реформ. Именно неолиберальные реформы и тотальная приватизация обязательно вернут ситуацию к возрождению диктатуры и полицейского насилия, вновь усилят как авторитарные силы реванша, так и тех, кто уже сейчас заинтересован установить в Беларуси режим внешнего управления – как прозападного, так и пророссийского. Мы считаем, что борьба за подлинную независимость рабочей демократической Беларуси – один из наиболее важных вопросов текущего момента.

Мы, рабочие и профсоюзные активисты Украины, не вправе навязывать наше мнение белорусским братьям и сестрам. Рабочие Беларуси самостоятельно выработают рабочую и профсоюзную программу борьбы. Однако мы принципиально считаем, что имеем право высказать свои предложения, которые могут стать хорошим подспорьем в выработке текущей рабочей и профсоюзной программы и пакета требований белорусских рабочих. Среди них:

  • Немедленная отмена антирабочих и антипрофсоюзных изменений в Трудовой кодекс Беларуси 2019 года, которые установили в стране полный диктат работодателей – срочные трудовые договора, возможность беспрепятственного увольнения рабочих по инициативе директоров, фактический запрет увольнения рабочих по собственному желанию.
  • Сохранение рабочих мест! Запрет на штрафы со стороны директоров предприятий! Запрет на лишение рабочих их премий!
  • Немедленная отмена правительственной программы приватизации на 2020 год! Пересмотр уже проведенной приватизации целого ряда ведущих предприятий Беларуси в направлении их национализации и введения демократического управления национализированными предприятиями. Последующая передача национализированных предприятий Беларуси под рабочий контроль и управление самими работниками и их профсоюзами! Рабочее самоуправление вместо государственно-бюрократического управления!
  • Остановить намеченную властями антинародную «лукашистскую» реформу пенсионного обеспечения! Немедленная отмена повышения пенсионного возраста, проведенного Лукашенко в 2020 году!
  • Немедленная отмена всех законодательных ограничений для создания рабочими Беларуси своих собственных организаций – независимых профсоюзов! Полная свобода рабочей и профсоюзной прессы!

Борьба за реализацию рабочей программы переходных требований возможна только при одном условии – рабочие Беларуси могут и должны наладить собственные устойчивые и прочные связи между трудовыми коллективами, между независимыми профсоюзами предприятий, между гражданскими и экологическими активистами. Праволиберальные силы сейчас являются куда более организованными и попытаются сделать все возможное и невозможное для того, чтобы рабочий класс Беларуси не стал самостоятельной политической силой, а послушно бы плелся в обозе неолиберальных политиков с их антинародными планами неолиберальных капиталистических реформ. Поэтому было бы правильным независимым рабочим профсоюзам Беларуси обсудить вопрос по выдвижению своего кандидата на будущих президентских выборах. Он сможет стать центром притяжения всех подлинно демократических и рабочих сил Беларуси. Выдвижение профсоюзного кандидата в Президенты Беларуси может стать реальной стратегической альтернативой, как силам антирабочего авторитарного реванша, так и многочисленным кандидатам пророссийского или прозападного империалистического толка, уже сейчас настроенным на ликвидацию независимого политического курса будущей свободной и демократической Беларуси.

Уважаемые наши белорусские братья и сестры по рабочей и профсоюзной борьбе! Украинские трудящиеся вместе с вами! В борьбе обретешь ты право своё! Ucrania: ¡detengamos la ofensiva del gobierno contra los derechos laborales de los ciudadanos!

Este material se está escribiendo cuando en Ucrania acaba de estallar un gran escándalo. La presidenta de la Comisión parlamentaria de política social, Galina Tretyakova, autora del proyecto de la ley antisindical número 2681, ha declarado públicamente que en las pobres familias ucranianas que necesitan asistencia social del Estado nacen los niños de «escasa calidad». Además, ha dicho que le impresiona la experiencia de Singapur con su esterilización forzada de las madres que no pueden criar a sus hijos sin el apoyo del Estado.

En este contexto de tristes analogías con la eugenesia, seudociencia hitleriana, parece absolutamente esperado el ataque del partido presidencial «Siervo del Pueblo» contra los derechos sindicales y laborales de los ciudadanos ucranianos. Durante los últimos 15 años, las sucesivas autoridades burguesas de Ucrania van tratando de «modernizar» la legislación laboral de Ucrania y, en primer lugar, decretar la nulidad de las normas del Código del Trabajo que sigue en vigor desde 1971.  Por supuesto, el Código del Trabajo de 1971 ya se ha actualizado muchas veces y, paso a paso, ha ido perdiendo sus funciones de protección de los derechos laborales de los trabajadores.  Sin embargo, en este momento el Código sigue siendo nuestro puesto avanzado en la lucha contra la liberalización de las relaciones laborales en Ucrania exclusivamente a favor de la patronal.

¿Qué innovaciones antisindicales ofrece el Siervo del Pueblo en su proyecto de la ley No. 2681?

1. Se revocan los poderes de los comités sindicales (órganos sindicales electos) de exigirles a los propietarios de las empresas que rescindan el contrato de trabajo con el jefe de la empresa si éste infringe las leyes laborales;

2. Se introduce una restricción absolutamente insensata sobre la formación de más de dos sindicatos en una empresa. Actualmente, muchas empresas importantes de Ucrania pueden tener incluso más de 10 organizaciones sindicales diferentes. Es decir, los patrones crearán 2 sindicatos «amarillos», mientras que otros sindicatos combativos ya no podrán organizarse en la empresa;

3. Los comités sindicales pierden su derecho a coordinar la aplicación de sanciones disciplinarias (amonestaciones) a los miembros de los comités sindicales;

4. El despido de los miembros de los comités sindicales se efectuará sin acuerdo del organismo superior del sindicato;

5. Ahora, para crear una organización primaria del sindicato, serán necesarios al menos diez miembros, y no tres como hoy.  Esto resultará en que será imposible fundar sindicatos en pequeñas empresas y en subdivisiones autónomas de las empresas.

6. Los sindicatos ya no podrán controlar las actividades de los comedores, residencias, jardines de infancia y otras instalaciones sociales pertenecientes a la empresa;

7. Los sindicatos no podrán exigirles a los empleadores que presenten documentos sobre las condiciones laborales de los trabajadores;

8. Los sindicatos no podrán controlar la nómina y las cuentas de seguro social del Estado;

9. Cesan las deducciones obligatorias de las empresas a las organizaciones sindicales primarias para la organización de actividades culturales, deportivas y recreativas;

10. Se elimina la prohibición a los jefes de despedir a los ex miembros de comités sindicales durante 1 año.

11. El empleador no paga a los miembros de los comités sindicales por 6 días al año que se les asignan para su capacitación sindical.

No están enumeradas todas las innovaciones antilaborales del proyecto de la delictiva ley número 2681 promovida por el grupo parlamentario del partido presidencial «Siervo del Pueblo». Hoy, los derechos sindicales son sometidos a una constante presión. Debido a los casos impertinentes de inobservancia de las garantías e incluso de la persecución de los sindicatos, Ucrania, junto con Bielorrusia, ocupan los puestos más bajos en Europa en el ránking del Índice Global de Derechos de la Confederación Sindical Internacional (ITUC Global Rights Index – 2019).  Una oleada de reformas neoliberales del gobierno de Zelensky le ahoga a Ucrania. Sin embargo, cada día se está fortaleciendo la resistencia a esta ofensiva contra las masas populares. Tanto la postsoviética Federación Sindical de Ucrania como los nuevos sindicatos independientes se han unido para contrarrestar los planes del gobierno.  La Confederación Sindical Internacional (CSI) y su líder Sharan Burrow han declarado claramente a todo el mundo: «Cualquier promoción sucesiva del proyecto de la ley No. 2681 sin una real y significativa participación de los sindicatos, así como su inconsistencia con las normas laborales internacionales y la Constitución de Ucrania, socavará la reputación de Ucrania como un confiable socio comercial e internacional».

Los trabajadores y los sindicatos tienen por delante las batallas decisivas por la preservación de los derechos laborales de los trabajadores ucranianos. ¡De la unidad nace nuestra fuerza!

Ukraine: We Must Stop the Government´s Offensive Against People´s Labor Rights

This article is being written while a great scandal has just broken out in Ukraine. The chairperson of the Parliamentary Commission for Social Policy, Galina Tretyakova, author of the anti-union bill No. 2681, has publicly stated that “poor quality” children are born to poor Ukrainian families in need of state social assistance. In addition, she has said that she is impressed by Singapore’s experience with its forced sterilization of mothers who cannot raise their children without state support.

In this context of sad analogies with eugenics, Hitler’s pseudoscience, the attack by the presidential party “Servant of the People” against the labor rights of Ukrainian citizens seems absolutely expected. Over the past 15 years, successive bourgeois authorities in Ukraine have been trying to “modernize” Ukraine’s labor legislation and, first of all, decree the invalidity of the rules of the Labor Code that has been in force since 1971. Of course, the 1971 U has already been updated many times and, step by step, it has been losing its functions of protecting workers’ labor rights. However, at this time, the Code remains our outpost in the fight against liberalization of industrial relations in Ukraine exclusively in favor of employers.

What anti-union innovations does the Servant of the People party offer in its draft of Law No. 2681?

1. The powers of union committees (elected union bodies) to require company owners to terminate the employment contract with the head of the company if the latter violates labor laws are revoked;

2. An absolutely senseless restriction is introduced on the formation of more than two unions in one company. Currently, many major Ukrainian companies may even have over 10 different union organizations. In other words, the bosses will create 2 “yellow” unions, while other militant unions will no longer be able to organize in the company;

3. Union committees will lose their right to coordinate the application of disciplinary sanctions (reprimands) to members of union committees;

4. The dismissal of the members of the union committees will be carried out without the agreement of the superior organism of the union;

5. To create a primary union organization, it will take at least ten members, and not three like today. This will result in the impossibility of founding unions in small companies and in autonomous subdivisions of companies.

6. Unions will no longer control the activities of canteens, residences, kindergartens and other social facilities belonging to the company;

7. Unions will not be allowed to require employers to submit documents on workers’ working conditions;

8. Unions will no longer control payroll and state social security accounts;

9. Obligatory deductions of companies to the primary union organizations for the organization of cultural, sports and recreational activities will cease;

10. The ban on bosses from firing former union committee members for 1 year will be removed.

11. The employer will no longer pay union committee members for 6 days a year that are assigned for union training.

Not all the anti-labor innovations in the draft of the criminal law number 2681 promoted by the parliamentary group of the presidential party are listedhere. Today, union rights are under constant attack. Due to irrelevant cases of breach of guarantees and even persecution of trade unions, Ukraine, along with Belarus, occupy the lowest positions in Europe in the ranking of the Global Rights Index of the International Trade Union Confederation (ITUC Global Rights Index – 2019). A wave of neoliberal reforms by the Zelensky government suffocates Ukraine. However, every day the resistance to this offensive against the popular masses is being strengthened. Both the post-Soviet Ukrainian Federation of Trade Unions and the new independent unions have come together to counter the government’s plans. The International Trade Union Confederation (ITUC) and its leader Sharan Burrow have clearly declared to the whole world: “Any successive promotion of the project of Law No. 2681 without a real and significant participation of the unions, as well as its inconsistency with labor standards and the Constitution of Ukraine, will undermine Ukraine’s reputation as a trusted international and trade partner.”

Workers and unions face decisive battles for the preservation of the labor rights of Ukrainian workers. From unity our strength is born!

Предложения профсоюза “Захист праці” в коллективный договор, которых как огня боится ДТЕК

Предложения «Захиста праці» в колдоговор  в Выделенном Подразделении Криворожской ТЭС ПАТ «Дніпроенерго»:

1. Вывод персонала в простой не по вине работника допускается только в случае полной остановки производства при следующих условиях:

-нет возможности предложить работнику другую работу с учетом специальности и квалификации на предприятии или другом предприятии, но в данной местности;

-простой должен быть пропорционально ровно разделен между работниками одной специальности, по  желанию работник может находиться больший период времени в простое;

– при нахождении в простое более 1 смены работник должен находиться дома, на работу прибывать по вызову руководителя. В случае нахождения в простое на предприятии работник должен быть на рабочем месте;

-производить предварительное согласование данной процедуры с профсоюзом с предоставлением расчета необходимой минимальной численности персонала.

-запретить работать персоналу на расширенную рабочую зону.Оплату простоя не по вине работника производить в размере должностного оклада.

2. Табельный учет рабочего времени во время простоя не по вине работника вести таким образом, чтобы образующиеся часы не доработки за счет простоев не учитывались как не выхода в табельном учете.

3. Запретить работодателю применять сокращение рабочего времени как изменение существенных условий труда без изменений организации в производстве и труде. 

4. В случае введения сокращения рабочего времени, данную процедуру согласовывать с профсоюзом, предоставив обоснование этой необходимости, подтвержденное расчетами и фактом изменения в организации производства и труда.

5. Запретить принуждение персонала к увольнению какими либо способами, применять к нарушителям меры дисциплинарного взыскания: выговор или увольнение.

“Захист праці” розпочинає пікетування прохідної електростанції ДТЕК

прийшов час діяти! рішуче та відповідально!!!

З 15 по 19 червня 2020 року Профспілкова Організація «Захист праці» у Відокремленому Підрозділі «Криворізька теплова електрична станція» Акціонерного Товариства «ДТЕК ДНІПРОЕНЕРГО” має намір провести 5-денне пікетування прохідної підприємства з вимогою до Адміністрації звернути увагу до справедливих вимог нашої профспілки, не ухилятися від соціального діалогу та нарешті розпочати процес спільної роботи з укладання нового колективного договору, який би врахував інтереси пересічних працівників електростанції.
